Terms and Conditions – MK Safety Solutions Ltd
Introduction
These Terms and Conditions apply to all bookings made with MK Safety Solutions Ltd. By booking a course, you agree to be bound by these terms.
Bookings and Payment.
All course bookings must be made in advance through our website, invoice or by prior agreement. Full payment is required at the time of booking unless otherwise agreed in writing. For corporate clients, invoices must be paid within 14 days of issue unless agreed otherwise. MK Safety Solutions Ltd reserves the right to withhold course access, refuse attendance, or withhold certification where payment has not been received in full. A booking is considered confirmed once payment has been received and confirmation has been issued.
MK Safety Solutions Ltd reserves the right to amend course fees at any time. Any price changes will not affect bookings already confirmed.
Cancellations and Transfers by the Customer
Cancellations must be made in writing. Cancellations made more than 14 days before the course start date will be eligible for a full refund or transfer. Cancellations made between 7 and 14 days before the course will receive a 50 percent refund or may be transferred to a future date. Cancellations made less than 7 days before the course are non-refundable. Course transfers are offered at the discretion of MK Safety Solutions Ltd and must be requested in advance. Only one transfer is permitted per booking. Failure to attend a course without prior notice will result in the full course fee being charged.
MK Safety Solutions Ltd reserves the right to charge a reasonable administration fee and recover any costs already incurred in relation to cancellations, transfers, or changes.
Cancellations and Changes by MK Safety Solutions
MK Safety Solutions Ltd reserves the right to reschedule or cancel a course due to operational requirements, instructor availability, or insufficient participant numbers. In such cases, customers will be offered an alternative date or a full refund. Liability is limited to the course fee paid and does not extend to any additional costs such as travel or accommodation.
Course Attendance and Conduct
Learners are required to arrive on time and attend all scheduled sessions. All participants must follow instructions given by instructors and behave in a professional and safe manner at all times. MK Safety Solutions Ltd reserves the right to remove any participant from a course if their behaviour is deemed unsafe, disruptive, or inappropriate. No refund will be provided in such circumstances.
Fitness to Train
Some courses involve physical activity and practical scenarios. By attending, learners confirm that they are physically and medically fit to participate. Any relevant medical conditions, injuries, or limitations must be disclosed prior to the course. MK Safety Solutions Ltd reserves the right to request a medical declaration, assess fitness to train on the day, and refuse participation if it is considered unsafe for the individual or others. Responsibility for ensuring a learner is fit to attend rests with the individual or the booking organisation.
Practical Training and Risk
Courses may include realistic and scenario-based training. While all reasonable steps are taken to ensure safety, participation involves inherent risks. By attending, learners acknowledge and accept these risks and agree to follow all safety instructions provided by instructors.
Assessment and Certification
Certification is subject to full attendance and successful completion of all required assessments. All elements of the course must be completed in full and to the required standard. Certificates may be issued by MK Safety Solutions Ltd or an external awarding organisation. MK Safety Solutions Ltd is not responsible for delays caused by awarding bodies. If a learner does not meet the required standard, certification will not be issued.
Failure to Complete Course
If a learner is unable to complete a course due to absence, failure to meet the required standard, or early withdrawal, MK Safety Solutions Ltd may offer the opportunity to re-attend or complete outstanding elements within a specified period. This may be subject to an additional fee. If completion does not occur within the agreed timeframe, a full course fee may be required to rebook.
Liability
All training is delivered by qualified instructors to recognised standards. Participation in training is at the learner’s own risk. MK Safety Solutions Ltd shall not be liable for any injury, illness, or loss sustained during training except where caused by proven negligence. To the fullest extent permitted by law, MK Safety Solutions Ltd is not liable for any indirect or consequential loss. Total liability is limited to the course fee paid. Nothing in these terms limits or excludes liability for death or personal injury caused by negligence.
Use of Training
MK Safety Solutions Ltd is not responsible for how skills or knowledge gained during training are applied after course completion. It is the responsibility of the individual or employer to ensure competence in real-world situations.
Course Materials
While all reasonable efforts are made to ensure the accuracy of course content and materials, MK Safety Solutions Ltd accepts no liability for errors or omissions. Course content may be updated or changed without notice to reflect current best practice or regulatory guidance.
Confidentiality
All parties agree to treat any confidential or sensitive information shared during the course as private and not disclose it to any third party without consent. This includes course materials, scenarios, and any client-specific information.
Data Protection
Personal information is collected and stored for the purpose of delivering training and issuing certification. This may include sharing relevant information with awarding organisations where required. All data is handled in accordance with the MK Safety Solutions Ltd Privacy Policy.
Course Locations and Logistics
Course venues may be subject to change. Reasonable notice will be provided where possible. Learners are responsible for their own travel, accommodation, and associated costs unless otherwise agreed in writing.
Corporate and In-House Training
For group or corporate bookings, minimum participant numbers may apply. Clients booking in-house training are responsible for providing a suitable training environment, including appropriate space, facilities, and any agreed equipment. MK Safety Solutions Ltd reserves the right to refuse to deliver training if the environment is deemed unsafe or unsuitable. Clients may be liable for any reasonable costs or losses incurred as a result of changes, cancellations, or failure to meet agreed requirements.
Force Majeure
MK Safety Solutions Ltd is not liable for failure to deliver training due to events beyond its control, including severe weather, illness, transport disruption, or government restrictions.
Governing Law
These Terms and Conditions are governed by the laws of Scotland. Any disputes will be subject to the jurisdiction of the Scottish courts.
